Lawful basis for processing information
The main primary legislation we work to is Environmental Protection Act 1990, EU Waste Framework Directive.
The main secondary legislation we work to is Waste (England and Wales) (Amendment) Regulations 2012, Environmental Permitting (England and Wales) Regulations 2010, Environment Act 1995, Waste Minimisation Act 1998.
We also rely on General Data Protection Regulation Article 6(1)(e) – processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.
How we collect information
Personal data is provided directly by you, as a resident, either by post, telephone, in person or electronically by email or via forms on the Council’s website. Information about residents may also be provided to us by the waste management service providers (Serco or Medisort in the case of clinical waste collections) where this has been collected directly by our partners who have been contracted to deliver the services on our behalf.
What information is collected
We will collect your name, address, contact information and details about the nature of your enquiry, for example what issue has been reported and details of what has been discussed. In the case of a request for service enquiries, information will also be collected about the items you want collecting and whether you meet the criteria for the service to be provided.
How we use the information provided
We use the information to provide waste and recycling services to residents in the borough, and to resolve complaints related to the waste and recycling services we deliver.
Who has access to the information about you
Members of the Waste Management team will have access to the personal data we hold. The providers of our waste management service, Serco and Medisort, will also have access to your details via an information sharing agreement in order to deliver the service. Our service providers may contact you directly in respect of a complaint or enquiry you have made to us, as they provide waste services on our behalf.
Who we may share your information with
Your information may be shared with senior managers in respect of a complaint.
How long we store your information
Your data is held in our Drupal and Whitespace applications. Drupal is the only system where personal data is stored which is retained permanently.
