Lawful basis for processing information

We process your personal data when you contact us to apply to manage a verge or open space.

Our lawful basis for processing your personal data is in accordance with the following legislation:

UK General Data Protection Regulation Article 6(1)(e) – processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.

The legislation which enables us to grant planting licences is in accordance with Section 142 of the Highways Act 1980. 

How we collect information

We process your personal data when you contact us to apply to manage a verge or open space. We need your personal details in order to progress your application and to communicate with you about the process, share information on green space management and land usage. 

What information is collected

Your name, contact details and residential address. We will ask you what your intentions are regarding using the land.

How we use the information provided

We use your personal details to check who owns the land as part of our assessment as to whether to grant a licence. We also have a duty to ask you how you intend to use the land as part of this process.   

Who has access to the information about you

Information will be held by the Council’s Infrastructure, Sustainability and Economic Growth service and shared only with the Council’s Neighbourhood Services Team, who will assist us with checking the ownership of the land, ecological impacts and managing contractors. 

Who we may share your information with

Your personal data will not be transferred outside the organisation. 

How long we store your information

The data you provide will be held for as long as you manage the verge/open space. Once you give notice that you wish to transfer management of the space back to the council, your details will be deleted.
