Our additional legal basis for processing your special category information is: 

Article 9(2)(c) processing is necessary to protect the vital interests of the data subject or of another natural person where the data subject is physically or legally incapable of giving consent.

Article 9(2)(g) processing is necessary for reasons of substantial public interest, on the basis of Domestic Law which shall be proportionate to the aim pursued, respect the essence of the right to data protection and provide for suitable and specific measures to safeguard the fundamental rights and the interests of the data subject.

Article 9(2)(h) processing is necessary for the purposes of preventive or occupational medicine, for the assessment of the working capacity of the employee, medical diagnosis, the provision of health or social care or treatment or the management of health or social care systems and services on the basis of Domestic Law or pursuant to contract with a health professional and subject to the conditions and safeguards referred to in paragraph 3.

Article 9(2)(i) processing is necessary for reasons of public interest in the area of public health, such as protecting against serious cross-border threats to health or ensuring high standards of quality and safety of health care and of medicinal products or medical devices, on the basis of Domestic Law which provides for suitable and specific measures to safeguard the rights and freedoms of the data subject, in particular professional secrecy.

Article 9(2)(j) processing is necessary for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes in accordance with Article 89(1) based on Domestic Law which shall be proportionate to the aim pursued, respect the right to data protection and provide for suitable and specific measures to safeguard the fundamental rights and the interests of the data subject.

How we collect your personal information

Personal information may be collected from you via post, paper, digitally via online forms, by post/email/phone and in person.

What personal information is collected

The type of information we will collect from you includes: 

  • Your name, address, telephone number and email address(es)
  • Date of birth
  • Contact details for members of your family and support network
  • Information about your finances, e.g. bank details, income, benefits
  • Photograph, for example to assist with an Occupational Therapy Assessment.

How we use the personal information provided

Your personal information is processed to:

  • Providing our services to you. 
  • Understanding your needs and preferences. 
  • Booking appointments for you.
  • Seeking your feedback and opinion on our services.
  • Inviting you to events and informing you about our services.
  • Informing you about changes to our services
  • Managing payments and for accounting purposes
  • Providing additional services, where available, at your request including skills training, adaptations and every day support services.
  • Managing complaints and quality management.

Who has access to your personal information

RBWM Council internal departments where there is a legal basis to do so, including Adult Social Care Services Team.

Who we may share your personal information with

We may share your personal information with other organisations for the purpose of:

  • Carrying out our function when making a referral or providing additional support services. For example, debt advice or domestic violence support organisations. 
  • Working with third party suppliers to perform their duties such as external printing service suppliers.
  • Where there is a statutory duty to share you personal information. For example, with our regulators including the Care Quality Commission.  
  • If required under an applicable data protection exemption such as for the prevention and detection of a crime or protect vital interests. 

How long we store your personal information

Your personal information is stored for seven years.  

You have the right to opt out from receiving marketing communications from us by following the ‘unsubscribe’ options or contact us by email and we will be able to assist you with this process.
