I hereby apply for information under the above Act in connection with a planning application approval, reference 22/02270/FULL, in connection with 41 Oldacres, Maidenhead.
You will see from the attached that I objected to the full application. My main argument is that the RBWM web site gives guidance for small detached buildings which states:-
· Single storey building, with a floor area which does not exceed 15m2, which contains no sleeping accommodation, constructed of any material.
· Single storey building with a floor area which does not exceed 30m2, containing no sleeping accommodation, and constructed substantially of non-combustible material, or sited at least Im from the boundary of its curtilage.
· Nuclear shelters under 30m2 floor area. Excavation for shelter not to be nearer to other buildings than the depth of the excavation plus 1m,
The building that has been erected is 20cm away from the fence and I have referred to this breach of the above 'exemption'. I have never had an answer to this question and therefore I wish to know how the decision to approve the construction was taken. Please provide evidence that my objection was taken into consideration and on what basis this was overruled.
The other matter that I wish to see evidence of is the requirement under Building Regulation 16 that specifies that work on construction can be started 48 hours after submitting a Full Plans application. Work on this building was completed before any application was made for full planning approval.
I wish to see evidence as to how this was taken into consideration when full planning approval was given.
Building Regulations apply when 'sanitary equipment (toilets, washing facilities etc)' are installed. It is known that this building has a toilet installed, and I assume washing facilities. I require, therefore, to know whether building regulations applied to this installation and what provision is there for the removal of waste. I especially ask this as the installation of a toilet was not included in the plans submitted with the full application. I require to see evidence that a planning officer undertook an internal inspection of the building before approval was give. The building is a 'multi-media' room. I quote below from building regulations
Part E:- I) BUILDING RI GULATION',: APPROVED DOCUMENT PART E 2003 (ENGLAND AND WALT `,) WHAT DOES PART E COVER? This document, which took effect on July 1st 2003, aims to improve standards of sound insulation in buildings, between homes or in rooms used for residential purposes. It is designed to meet the demands for improved acoustic insulation and combat the problems of noise pollution from noisy neighbours. During the construction of the building there was no evidence that sound insulation was installed. I require evidence that sound insulation was considered and if so why was it not insisted on as part of the conditions of full planning permission being granted?
The issues that I have highlighted in 'bold' are the issues that I require evidence from a Freedom of Information request.
