I understand that under section 31 of the Highways Act 1980, local authorities are required to keep a public register of all landowners through whose land run public highways and rights of way (such as footpaths, bridleways and roads). I further understand that to register, a landowner has to deposit a statement and a map with their Local Authority – showing the boundary of their land.
I also understand that a similar procedure exists under section 15A of the Commons Act 2006 which enables landowners to protect themselves against a parcel of land being registered as a village green or common based solely on a period of use by the public.
Under the freedom of Information Act 2000 and the Environmental Information Regulations 2004, I would like to request a copy of any statement and map that the Duchy of Cornwall had deposited with your local authority under section 31 of the Highways Act 1980 and section 15A of the Commons Act 2006.
